HI all
I am from India. My I-130 got approved (spouse) and transfer to NVC. I have 2 months old boy back at home. I submit his birth certificate at NVC.
1) My status as LPR he can come with my wife as dependent.
2) in next few months I am going to be a USC. May be by Feb-March 2014.

Question : should I have to wait for the processing at NVC, how long it will take to process a case at NVC under (LPR).
I read in that kinda cases NVC charge fee for child and process the case. But what will happen once I will be a USC.

or upgrade it after I will be a USC. In that situation I have to file a new I-130 for my son and it's all new process and time difference in boths cases.
Any suggestions will be appreciated.
Thanks

While you are still an LPR, your son can be added as a derivative to your wife's application.

But if you become a USC, you would have to file a new I-130, which would delay his immigration by several months. So it would be a good idea to postpone your citizenship oath until after they immigrate (or don't apply now if you haven't applied yet), unless F2A retrogresses and puts you in a situation where their immigration is delayed anyway.

Hi jack thanks for reply . Here is some dates.
Priority date april 2012
Case transfer to nvc nov 1 2013
Usc fingerprint done on oct 21 2013
Question
My priority date is current.
Is it possible after usc interview can I delay for oath ?
How long do you think it will take at nvc I check some cases usually it's show 4 to 5 months.
One of my friend have same situation and they asked nvc about it. Nvc told them to deposit child fee.

Thanks for help n plz let me know more about it
Thanks again

Is it possible after usc interview can I delay for oath ?

Yes. At the interview you can ask that they give you an oath after a certain date. Then if your oath date approaches and they're still waiting outside the US, request a reschedule of the oath.

You can't reschedule the oath forever though. After 2 or 3 reschedules they'll terminate your application if you reschedule again or don't show up.

Thanks jack. I appreciate for your answer. Yes I hope it will work for me. Most cases I saw completed in 4 to 5 months.
Thank you so much

Hi Jack

Now my case is complete at NVC on 27th jan 2014
Waiting for interview letter.
Still I don't received my oath date for citizenship may be in a few days for march. And by that time may be I have interview letter too.
So what to do let it go like that.
Once NVC complete the case or transfer the case to counslar office and I got oath still I have to let them know about my citizenship or let it go.
Thanks for any kinda suggestions

At the naturalization interview, ask for them to delay your oath date.

Once NVC complete the case or transfer the case to counslar office and I got oath still I have to let them know about my citizenship or let it go.
You have to let them know. If she immigrates as F2A when you're a citizen that could cause problems for her green card or naturalization in the future.

Hi jack
I reschedule my 1st oath ceremony. It's only a month the schedule for 2nd oath ceremony.
Should I have to reschedule 2nd one too.
Wife has an interview on 8th april.
And uscis send me letter for 2nd oath ceremony on april 4. It's very stressful.
Is it ok to reschedule this one. Or they can deny my application.
Thx for help
