New Biometrics Request--need Some Answers

Friends:

I am an EB-1 from a non-retrogessed country. My ND is March 2003. Until last week, I have had NO INFORMATION on my case. I did my first set of biometrics in April 2003 and my second set in November 2004. I have had a congressman's and a senator's aides do inquiries on my behalf since October of 2004. Until last week, I had the same response from the congressman or senator's aides: My security clearance was pending. Last week, one of the aides called me to tell me that apparently my application has been given security clearance.

Today I recieved ANOTHER biometrics request for August. This request came from USCIS.

WHAT DOES THIS ALL MEAN? Why are they asking for fingerprints again? Does this mean that I am BACK TO SQUARE ONE? That USCIS is only NOW starting to process my application? In that case, are we talking more years of waiting? How many more years are we talking here? My H1-B is nearing its 6th year. I am at my wit's end.

Can someone please help me answer some of these questions? I want to thank all repliers in advance. For your time, you have my gratitude.

Let me be the first one to congratulate you in advance. I am sure that your FP Notice Code will be 3.

"Last week, one of the aides called me to tell me that apparently my application has been given security clearance." This means that your case is approved. They just have to do some formality. They will take your Biometrics and you will get your approval within a week. Just wait for some more time and have patience and be relaxed, your wait is over. ;)

Hope this will relieve you of the tensions you have been going through. Enjoy your life now. Dont worry too much. :)

Thank you for your very encouraging and nice note, but my FP code is 2!!! What does that mean? It sounds like it just means that I am just back to square one?

No. I didn't see that you have done your second set of FP in Nov '04. I think back then you must have given all the 10 Finger Prints. Code 2 means that your previous FP are still valid less than 12 months and this time they will take your index finger print, your digital photograph and digital signature. Code 3 means that they will take all the 10 Finger prints + index finger print + digital Picture + digital signature. This is for your GC card. Your GC card will be mailed to you directly when you I-485 gets approved. You need not go for PP stamping [unless you have to go out of US either on Business trip or your home country [emergency situations] ].

so do you mean code 3 is good news? I have not received i-485 approval, and I have done finger prints twice (the last one was May 2004). What's the difference between finger-print notice and biomatrix? So complicated, so strange, I am lost.

If I am understanding this right, Biometrics is the same as fingerprinting--but Biometrics can also include photography--which is why it is NOT called just notice for fingerprinting. I think that's the difference. Also the codes seem to indicate which level you're on? Sounds like Code 3 IS good news.

I must say that you have a very optimistic view of my case--and that gives me hope! After almost 30 months of waiting with no movement on my case, I am still VERY wary. My questions to you are:

1. What does this call for Biometrics Code 2 mean in terms of WHEN my I-485 will be approved?

2. Does Biometrics Code 2 mean that my I-485 WILL be approved, or is it still up for grabs and review?

I read on another thread that someone got Biometrics Code 2 done back in 2004, and still doesn't have a green card. NOW that makes me very nervous.

1. Code 2 is usually given for people who's FP [All the 10 fingers] are still valid. Since, you are in EB-1 category which is current, that means they have visas available in that category, your GC will be approved as soon as they will recieve your Biometrics.

2. There are no more grabs or reviews.

3. It must be for EB-3 category. Since, the EB-3 category is unavailable worldwide. there are no visas available in that category. that could be the reason that "someone" is still waiting for approval.

I completed my FP in June 2004 & received a Biomatrix notice with case type 2.

When is the likelyhood of GC approval?

Since EB3 category visas are are all utilized so this mean atleast not in near future!
 
educatedcat, I would like to congradulate you in advance for your soon coming approval. Let's not to pay much attention to biometric codes, these days they don't mean much rather than standard procedure for your GC upon approval. What it matters is your security clearance. If one gets caught there, nothing really helps. Like some of us here have this unfortunate situation. Now your biggest barrier is gone, you can just relax, and look forward to the good news!!

How can one know that USCIS has initiated name/background check clearence? Is there a way to find out? Why some guys like you stuck in background check? Is it based on "name" or the country of birth?
 
perm_lc, as of my knowledge, USCIS initializes your name check several weeks after receives the application in general, and then it may take several weeks to several years to complete. You will not be informed the detail procedure USCIS performs. The information from this forum shows that almost 90% of name checks finishes in a reasonable time frame, however, people like me are stuck in name check and we don't know how much more longer we have to wait. I found out this unfortunate situation by initializing an inquiry on my case after it passed the USCIS time frame. I hope you don't have to get to this point. In addition, there is no solid evidence that people from certain countries will trigger longer process than others. Delay could happen to any people from any background. Good luck to all of us!!
 
I agree with the posts here that your GC might be around the corner ... reason being that you had done your FP2 in Nov which is still valid and USCIS is asking for Biometrics code 2 which is Index Finger + Photo + Signature - you can certainly hope that soon you'll see an approval plus card soon.

My comments are based on the general trend, there is no science behind it. But, looking at your case, logically this analysis should be very close ;) .

In my case similar thing had happenned, my Biometrics Code 3 were take on April 22nd, and for my Son (minor) code 2 were taken on June 4th. On July 22nd I received my approval mail and on July 26th I received a mail stating that cards are mailed. Now everybody in my family my wife, son and I have received our GC plastic card. But, I have seen some cases here on this forum where it did not happen.
