New Applications for OCI After June 1 2010

I have been trying to get information on the OCI process and requirement of cancellation of Indian passport for those who had acquired US citizenship prior to 2005 and are filing new applications for an OCI after June 1 2010.

NYCG does not have clear instructions or requirement posted on their site. On their How To Apply page for Surrender Certificate it states that Applicants who also need to
apply for Overseas Citizenship of India (OCI)or Persons of Indian Origin (PIO) card by
mail, may send their OCI/PIO applications and ‘Cancellation of Indian
Passport/Obtaining Surrender Certificate’ applications in the same envelope with
separate document sets and fees. I thought that one needs to submit the canceled Indian passport at the time of collection of the OCI card.

Also there was a clarification by Dr. A. Didar Singh, Ministry of Overseas Indian Affairs (MOIA)

which states:

4. As regards the surrender of Indian passports last held by such PIOs, it has been clarified by MEA vide their circular letter dated 03.05.2010 [para 2(viii)] that there would be no need to surrender a passport which expired before 2005.

So if one doe not have to surrender a passport that has expired before 2005, why it is to be canceled and required for receiving an OCI card?

Has any one submitted an OCI application after June 1, 2010 whose Indian passport has expired before 2005?
