New 20,000 H1b allocation

Hello,

I'm wondering if anyone knows if Physicians (IMG M.D.) with US residency and/or fellowship are considered as equivelant of higher degree from US institutions for the purpose of this H1B increase.

Obvioualy, it's not a straight-forward case of awarded degree from US institution. Having fellowship will increase chances, however, lawyer has to argue strongly that your years of training/fellowship in US meets higher degree/education requirements of degree obtaining in US.

according to visalaw, it looks, if you apply for 20,000 and have starting date, let us say before October 1, and 20,000 numbers are up, USCIS will automatically assign the application for FY2006 with start date of October 1.

Now the question is, if you apply and you're not eligible for this 20,000, would USCIS automatically assign to FY2006 with new start date. The reason I'm asking to save on the filing fees which add up.

I dont think there would be additional/double fee if uscis converts to regular fy2006 quota.
 
Do 3 years of residency in US and then 3 years of fellowship in US and still, by USCIS, criteria you dont have an advanced degree!!!!!!
Wonder what the USCIS has against physicians?
 
The reason this extra quota was introduced was that the large research universities saw their supply of ultra-smart but low-wage (mostly chinese) graduate students dry up. The prospective students realized, that with the H1b quota it became close to impossible to jump into industry after they finished their PhD. (Rather than dealing with the visa hassles in the US, many of them in the past couple of years chose to go to places like the UK).

The reason why congress doesn't care about physicians is bc there are so dammn many of us. No matter how hard they trample on us, the supply will never cease.

addendum:
reading my post I noticed that I seem to imply that chinese=low wage. I don't. These are the smartest people this country has to offer. What I tried to express is that foreign graduate students are less likely to negotiate a good 'deal' when they go for a PhD program. US grads will shop around to get a good travel fund, book allowance etc. Someone from overseas is more likely to take the universities offer 'as is' 'sight unseen'. Didn't intend to offend anyone based on race, national origin or religion.

Fact is, there is no single HealthCare employer participated/lobbyed for H1-quotas for "Physicians'. But, we see lot of lobbying for 'Nurses' in health care profession. Surprisingly, most of hospitals/residensy-providers are 'indifferent' /passive, some have harsh policies against hiriring H1 based residents/physicians. 50% states like CA, TX, discourage hiring physians on H1.
