Needs Advice on Traditional Labor Cert

Hi,
I have pending labor cert filed in 2004 by Tradional filing. My attorney suggested that we will refile through PERM. But I am not sure if it will benefits me by doing refile through PERM. Since if it is true that DOL will eliminate the BackLogs by end of Sept 07, then I it does not make sense for me to refile. Please advice. Thank you much.

I would suggest filing thru perm too atleast as a backup.You never know if backlogs will be eliminated as promised and then if visa dates advance you will be able to file for your 485 thru your perm application and atleast get an EAD and change employers as you wish.
 
Hi nickmon, If you are planning to file through PERM separately, then as far as I know it cannot be in the same category. For example if you have a labor pending in EB3, then you will have to file a PERM in EB2. Otherwise you will have to pull back the application in BEC before filing a perm in the same category. If you are planning for the later, then your reasoning seams right. If you are planning the first way, seperate PERM in a different category, then I would agree with SLN2001. Just my 2 cents worth.
 
Talk about getting screwed

So today is the 1500'th day I am waiting on the my TR labor. Now everyone that started their processing 4 months ago is getting in the I140/485 line ahead of me. I dont think I have hated anyone this much before :mad:

mine is TR too, PD July-04 and still stuck at DBEC
i hope backlog will be eliminated altogether (TR & RIR) on 9/30/2007,
so I'm waiting, hoping & praying that everything will go well.....

i'm not gonna try PERM since it will cause more complication :p

Don't sweat it too much. Dates might remain current till end of this fin year and you may still be able to file before dates retrogress again.
 
Hi guys,

PD: 1/2004, non RIR EB3, massachusetts

DOL website has been showing In Process since eternity, haven't received any further recruitment instructions or any thing. Wanted to check the status of others in massachusetts who have similar PD in EB3 non RIR. Is there a website to check for the Philly backlog elimination center job postings?

Any suggestions, should I try to file under PERM. I am on H1B extensions now, can I sill file under PERM?

Also, is there any USCIS website or briefing on how long the date will remain current?
