I re-post this message for my friend in this forum.

My close friend's husband asked me some question EAD, he thought I know this type of questions. But I do not know what to tell him. Need guru's help in this.

7 years ago, he applied EAD in summer break while he was student. and got the receipt number, and he did not receive the actual card due to lost mail or something. but he worked in somewhere in summer (less than 180 days) and he recalled he got some payroll checks around that time. The Case status on line for that EAD reads "the card was returned and distroyed due to undeliverable........"

He left this country after he finished the degree. He reentered USA as F1 in 2002. He currently is I-485 pending using EAD. He is worried about the 3 months work (part time) without the proof of actual EAD card.

Questions:

1. Any negative impact on his I-485 case?
2. What can he do at this point?
3. Does he need to contact immigration lawyer who handle his i-485?
4. Can some one tell more about 245(k) or something like that. Does 245 (K) apply to him? If so, what to do?

Any suggestions will be helpful. I will strongly suggest the forum to him so he could seek help himself.

Hello there

>>1. Any negative impact on his I-485 case?

The best advise he can get from an honest attorney. did he filed 485 himself? or attorney did? assuming he wrote all info on his best knowledge and understaing. USCIS do have tolrance policy in many cases. honestly noone pettition is perfect. it they point out the issue it can be solved by explaining them that they understood. and attorney would help u in this. at this point tell him not to worry much, don't try to explain anyting unless is asked.

>> 2. What can he do at this point?
nothing just wait and watch, hope for good and pray :D noone is perfect neither anyone pettition is. :D

>> 3. Does he need to contact immigration lawyer who handle his i-485?
its better wait and watch, as some greedy attorney never hesitate to get cash from your fear. even there is nothing to worry about. pettition has gone, just wait and watch.

>> 4. Can some one tell more about 245(k) or something like that. Does 245 (K) apply to him? If so, what to do?

Red this plz :D

Tell him not worry much about it, panic will make things worst and noone is big enemy than 'his own fear'.
Relax, be patient, wait and pray and Trust on Almighty God everything will be fine. :D

Good LUck

Thank you, PrinceofJungle!

Thank you!!

I just called my friend. He felt much better after he read your comments.

His wife applied i-485 through a lawyer. He is not the primary applicant.

"otherwise eligible" to immigrate to the U.S., immediate relatives may adjust status to LPR (get a "green card") in the United States even if they may have done any of the following:

worked without permission,

remained in the U.S. past the period of lawful admission (e.g., past the expiration date on your I-94) and filed for adjustment of status while in an unlawful status because of that,

failed otherwise to maintain lawful status and with the proper immigration documentation, or

have been admitted as a visitor without a visa under sections 212(l) or 217 of the Act (which are the 15-day admission under the Guam visa waiver program and the 90-day admission under the Visa Waiver Program, respectively).
