Hi All,

Need your help and suggestions.

I guess, you must have answered 1000 times, but still I have some questions lingering in my dead brain.

Today I saw couple of emails for me and my wife stating " I-485 case is transferred to local San Jose office and an interview will be scheduled in couple of months”

1.Lot of activity was happening on my pending applications for a 1 month or so.

a. Asked for status inquiry for pending I-140 20 days back, it's been nearly 3 months since we answered RFE no reply from USCIS.

b. Changed address 2 weeks back

c. Completed fingerprint 1 month back.

d. Called USCIS 4 times in last 1 month for various reasons, address change, check the status of fingerprint,etc...

Do you think any of the above events triggered this move? Currently VSC is processing dates for June'03 and my priority date is Dec '03 and my question is why so early?

2. I heard some members had to reschedule their appointments because , when immigration officer found their FBI name check was not done, I-140 still pending etc..

a. I sent couple of emails to FBI for name check last 3 weeks back, not heard so far.

4. What will happen to my pending I-140 ?


5. What documents will i need for interview?


6. Can I ask my attorney to accompany me?

Guys,

And also, i was never convicted or tickets against me . Is that true , USCIS picks cases randomly and send it to local offices.

Any thoughts ?

I think it is random unless specific reason such as AC21. What was your RFE for.

RFE was on” “Ability to pay issue”

Here is the complete story: company xxx filed my labor (Dec 2001) when I used to work for him, and I had to leave this company(Aug'2002) due to down turn of economy and joined company YYY,becuase of good faith with my employer he continued my process and my labor got approved in (July 2003) and he agreed to file my I-140 and
I-485(Semie concurrent) and I promised to join him after GC process , all in good faith.

Currently, I left YYY company and joined back xxx company in Nov'1st 2004. On Jun'1st 2004 I got a RFE for "Ability to pay issue" and my attorney and employer answered this RFE on Aug18th 2004. Since then my I-140 is pending. We made a status inquiry 20 days back.

1. Company xxx Employment dates (Dec'2000-Aug'2002)

LC was for $90k

2.In Year 2002 I had to take unpaid vacation to India for 3 months. W-2 for year 2002 looks less than what I showed in LC.

3. All this time I was getting the LC salary for last 3 years with YYY Company.

4. Now company xxx is paying my labor salary.

Where do you think the case is going? Do I have strong case for an interview?

One correction, I am still on H1B and I haven't used my EAD to file AC21 to change employer.I have good 1 year left on my H1B , which I want to use before using EAD. For change of employer, I used H1B transfer.

4. What will happen to my pending I-140 ? Should this be approved before i go for a interview ? If not , will officer ask me to come back ?

6. Can I ask my attorney to accompany me? Reason is, My attorney is located in east coast .

Sorry, if i am not clear. Primary(myself) and spouse both cases were sent to local office.

Regarding my wife she is on H4 status and never convicted or never worked.

Help, HELP: RFE after EAD has been approved

Hello,

Mine is very strang situation. My EAD has been approved.
But after 10 days it has been approved the on-line status
says that an RFE has been issued on my EAD case.


I recently changed my job using filing AC21. I used my i-EAD
to change my company. My actual EAD got approved after
I changed my job but I still had a valib AC21.

Has this happened to anyone?
is my approved EAD still valid?

My I-140 is approved.

My EAD was approved and I got my EAD card. Now it says
they needed more information.
ANy thoughts?
The message says

concerning your case. If you have not received our response within 30
days from this date, please call customer service at 1-800-375-5283.
*********************************************************

that's not an rfe. RFE would be "we requested". "we responded" means you or your lawyer have made a query to uscis. it could be address change or an inquiry as to the status of EAD prior to you getting it approved.

nothing to worry about as it is not an rfe.
