Need Urgent Information on filing I485 \EAD

My priority date is May 2004 and I-140 has been approved in April 2006 from Nebraska Service Center. I have already completed 6 years on H1B and currently on the 7th year extension.

My attorney informs me that I cannot file I485 till the priority date is current. I want to confirm this. What are the current priority dates for Nebraska?

My visa has expired in May 2006 and I want to be able to travel out of USA. I have learnt that you don't need a visa when you obtain Advance Parole. Am I eligible for filing Advance Parole? what does it involve?

once you have approved I-140 but could not be able to file I-485 since your priority date is not current - you are eligible for a 3 year H1B extention.

you attorney is right. you will not be able to file your I-485 till your priority date is current. it also depends upon which EB category you belong to.

only when you have a pending I-485, you can apply for EAD / AP. Otherwise you have to survive on H!B. there are lot'a experts in this forum who can help more on this subject.
