Hi,

My H1B was picked in 2nd lottery last year.

Notified RFE, But the letter was not received, even after the service request was raised.

Before completing the 30-day response period for a service request, the case is denied.

Denied letter as well not received in 2 weeks.

The delivery address is correct, for other letters no issue.

Can someone, please suggest further steps should take to reach out to USICS and get letter details?

That sounds like a frustrating situation. Here are some steps you can take to reach out to USCIS and get the details of your H-1B denial:

1. Check Case Status Online:

  • Visit the USCIS Case Status Online tool
  • Enter your receipt number (from your initial H-1B filing) to see if there are any updates on your case status, including the denial notice.
2. Contact USCIS:

  • USCIS Contact Center: Call the USCIS . Explain your situation and request a copy of the RFE and denial notice. Have your receipt number ready.
  • Online Inquiry: You can submit an e-Request through the USCIS website for a copy of a missing notice

Important Notes:

  • Time is of the essence: Even though the denial letter hasn't arrived physically, the 30-day response window for the RFE might have passed based on the online case status. Act promptly.
  • Gather Evidence: Keep copies of any communication you have with USCIS regarding the missing notices and the denial.
  • Consider Legal Counsel: While the steps above can be helpful, consulting with an immigration attorney can provide specific legal advice based on your situation. They can help you determine if there are grounds to appeal the denial based on the lack of proper notification.
Hopefully, by following these steps, you can get the information you need from USCIS and explore your options regarding the H-1B denial.
