Need urgent help!!! ... H1 expiring

Guys,
I am sure many of you know this out there. Please reply if you do.

My 7 years of H1 are expiring in Aug 2007. I can not extend it as my labor is denied. If I leave the country in Aug 2007 can I apply for a H1 when they start accepting applications in April 2008 and enter the country in Oct 2008 or do I have to wait for 1 year before I can file for H1 i.e. I will not be eligible for filing H1 until Aug 2008. Please help as I may have to plan things.
 
Find approved labor

1. Is the labor from the same(current) employer who holds you h1 got denied OR labor from previous employer which is 365 days got denied?

2. If you find approved labor , then you can file I-140 with premium processing and get 3 year extension. I guess this is only route you have to keep you in status after aug 2007

Please share your labor filings details.
