Need to make an imp decision : Please HELP!

Hi,

My H1B from previous employer is valid until Nov 15 2003 and so is my I-94. However, owing to my wife's passport expiration date, she was given a I-94 validity until Sep 15 2002. Now, my current employer has applied for my H1-B transfer and for my wife's I-94 new validation on May 22nd 2002 and they are still being processed.

Just yesterday, I have been offered a job by yet another employer which is quite important as far as my career is concerned. However, my current H1-B and my wife's I-94 validation requests are still being processed by INS.

Will such a situation of mine still enable me to shift jobs? If yes, is there anything I need to be cautious about? If no, what do I need to do to make it possible?

Yes, such transfers are possible. Make sure that you include information about the pending transfer (and H4 renewal) in the new set of applications.
It would be prudent to apply using premium processing and then after H1 (and H4 ) approval withdraw the previous pending transfer through the soon-to-be ex employer.
