Need to list all family members on I-140? Even members on F-1?

Do I need to list all my family members on I-140? My wife is currently a full time student and is on F-1 visa. My paralegal told me that I need to list her on my I-140.

AFAIK, I only need to list my dependents and my wife is on F1 so can be omitted. I want to omit her from I-140 and add her only on I-485. This way she stays on F-1 and can travel outside the country without any issues.

Any advice would be really appreciated?

Intentionally omission of information is called immigration fraud, and its the safest and quickest way of getting deported and banned from entering the US for life. The choice is yours.

It is omission only if I am required to list "non-dependent" family members on I-140. Which was my question to begin with.

You are trying to hide a spouse because you know that your immigrant intent also makes her ineligible for F-1 status. USCIS is careless, disorganized and incompetent, but not stupid.

Lalooji: Some people have obtained Green card sucessfully even on F-1 visas. You should mentioned your wife on I-140
