Need to know the details of forms for GC

Hi All,

Finally my time has come to apply for GC. I'm in US since last seven years. I came as a visitor (B1/B2) with a six months entry. Got admission in the university and changed my status to F1 and completed my MS and got an additional year on OPT. Found a job and also found the women of my dreams, fallen in love and got married. My to be wife was a Green Card holder since two years. In the mean time my employer filed for my H1. Since my job was steady and going on well and on H1, I had three choices.
1. Apply family based GC (but was adviced not to do so since it takes long)
2. Apply through my employer (would have been perfect but simply delayed and wasted time for no reason and also my employer told me to pay for the lawyer if he applies)
3. Wait for my wifes citizenship (perfect but a risk of 3 years on H1, since my wife had 3 years to apply for citizenship.)

The No.2 choice was good but life after marriage was very busy and since I had choices it just delayed. Now we are married since 4 years and have a beautiful baby boy who just turned one on August 30th. My wife applied for citizenship and it took a long time, it's almost 2 years now and she finally got her Oath letter.

It's time for me to gear up and need help in knowing the details. If someone has gone through the similar process, let me know what all forms are needed to apply for the processing. Some of my concerns.
1. I never went out of US and never got my visa stamped.
2. I was never out of status.
3. Now I want to go to my country India as soon as I get a travel permit.

Thanks.

I think you have to apply at the san francisco office

go to the website and find out uscis.gov

be sure and file for advanced parole or since you have an h1 you can get it stamped at the local office. but im not sure how the stamp works.

advanced parole is easy and you file it right with your application

form I-131

good luck to you

Are you sure all the forms should go to San Francisco office? I'm in San Jose and I think some forms should go to San Jose office. Let me research more because I've a doubt. Anyway, thanks for your reply.

We live in San Jose and all our forms were filed to SJ office. This is the office that serves Santa Clara county residents
We didn't apply advanced parole though.

sorry about that I think the group is correct

san jose office is probably where you file it

also find out if you need to file the medical exam now

every office seems to be different when it comes to that

also I do know that you can file the ap now with the application

and please by all means do that

good luck

I filed everything at San Jose office including AP and I have already collected the AP and EAD from San Jose office. waiting for the important interview date.
