Hi All,
I am currently on H1B (have H1B visa stamp on my passport). I plan on filing my I-485, EAD and AP applications very soon. I also want to make a trip home ASAP.
It is clear that a person can travel outside US on H1B while the AOS application is pending, however the requirement of carrying the I-485 filing/receipt notice along with the valid visa is not very clearly addressed.
The INS memo dated June 1999 states that a person needs to provide the valid visa and the original I-485 receipt notice at the POE, but the most recent INS memo dated May 2000 does not mention this requirement.
Does this mean it is not required to carry the receipt notice?
I need this information in order to decide if it is safe to travel without the receipt notice or just wait till the receipt notice comes through.
