Hi

I have applied my GC with the company A from Chicago on 2003.I got my EAD and its been more than a year and got the 2nd EAD also. Now another company B is offereing me very good position. And am planning to change the company.

1.The new job is going to be in New Jersey and there is a difference in Salary of around 30K. Is this okay?

2.Do i need to apply AC21 to change my job with the company B or can i wait for RFQ and give reply and also do i have to specify the Job Designation and Description in AC21?.

3.When I change my job, if my new employer can give exact job description and job designation in a separate document ( On an Official Company Letter )? Or it should be in an offer letter?

Thanks in advance

AC21 SALARY ISSUE......pls share your experience

seems like lot of us are in the same boat looking for such answers -
After reading through forums and talking to one of the lawyers, my understanding is.....
-- when to file AC21 : It's your choice , either file after getting the first pay stub of new job or when you receive RFE. Lawyer I talked to, said it's better to send AC21 letter to USCIS once you change the job to be on the safer side. (one of my friend did the same...)
-- Form of AC21 : It could be different from offer letter. A separate employment verification letter on company's letterhead describing the nature of job in detail should do
-- SALARY : EVEN I AM looking for the answer to this question as I am also being offered the salary which is > 25k then mentioned in my LCA.
Lawyer said as far as salary is concerned - it should not be less and having higher salary is not an issue but it all depends upon USCIS how they take it. So I am also a bit concerned about it because the AC21 memo said salary difference should not be drastic. Not sure what scale they use as Drastic :-)
