Hello,
I got approved my visa 9 months ago ,I am working in India as my Employer has not yet accepted my resignation, now that I came to hear that my employer ABC,TX has been black listed, will it be any problem to me if I come to US now ,or is it ok if I can get transfer my h1 in India itself .Can this be done?

I would appreciate if you could suggest me on how to approach further.

Thanks in advance.

If you intended to say that your employer has been blacklisted by USCIS or DOL or DOS or any US government body that supervises immigration, you should not be coming to US claiming to work for the employer, without performing some steps. The 1st step is that you should consult the employer and find out if the H-1B is still valid (there could be a case that employer's H-1Bs might have been cancelled).

A response to the above would determine next course of action.

John,
Thanks for your quick response ,I will contact the Attorney soon on this ,
the thing is my employer is not yet revealing the status of being black listed,I came to know from the External sources,I just want to be on safe side by transferring my H1 in India itself ,can this be done .I would appreciate if you could throw some more light on it.

Thanks&Regards,

-----------------------------NO, for H1 transfer you need to be on valid H1 status in US with valid I-94 so that new US employer can file H1 transfer.

I would appreciate if you could throw some more light on it.
