My grandmother is a US citizen and she filed a petition for my parents (mother and father ) along with myself and 5 other children under 21 years of age in the year 2000, it is now 2012 and my parents recently received a letter from the US embassy stating that my parents (MOTHER AND FATHER ONLY) has to pay a $230 US dollar fee EACH, but in the letter it did not mention any children, why is that ? and also myself and one of my siblings are over the age of 21 now, i would like to know if we would also be eligible as well since the petition was filed before we were over the age of 21?

Unfortunately your grandmothers petition for you cannot be approved. You are not an immediate relative. Your parents though are immediate relatives of hers.

False. For immigration purposes, as children of the petitioner they would have to be under-21 and unmarried to be classified as immediate relatives.

You might be eligible. Consulates often leave out the over-21 children without doing the CSPA analysis to determine eligibility. Then you have to assert your eligibility.

Are you still unmarried? When did you and your siblings turn 21? How long did it take for the I-130 to be approved? Those factors are needed to determine your eligibility under the CSPA.
