people,
i need some help here...i have a friend,he really is not aware of 1447 and stuff and he is in a bad financial situation too,so i want to help him out.the only time could find is today,so i need your help please as i am really busy tomorrow and i wont be able spend much time here...
please guide me...

a little history about his case...
he is basically from Pakistan.

he applied in sometime in 04
had his fp in 04
had his interview in 04(outcome,it states cannot make a decision as of now)
for some reason he held on for 2 yrs..
he took a infopass last week and they gave him a appointment for fp.
he had his fp taken second time lst week...


now my questions,

1)can we sue the uscis as of this moment....
2)what is the process,please provide me with links to documents...
Does he have to go through a second interview...

Appreciate that buddy,did a bit of googling and found some stuff,i have everything ready...just need to get a pro se document from court on monday and go through it once...
My only concern is i dont want to mess up with him,i am not sure if i can go for a 1447(b) as of this moment as uscis had him take another fp...i am not sure if we has to wait for the second interview and 120 days before filing a lawsuit...
coz i will be heading to india end of next month,i dont want him to be stranded by himself as these things which sound silly to us is a bit complex to him,and his poor wife for no fault of this is sitting in pakistan waiting for him to get his citizenship so he can sponsor her...

Filing 1447(b) is the better option. 120 days starts from the initial interview. If the USCIS has taken its time "which is their norm" you would not want to wait for a second int. Fingerprints expire after 15 months, so scheduling for a second one is a mere formality. 8 U.S.C 1446 and 1447(b) applies when 120 days has passed after the inital interview.

aka really appreciate your help...man i was about to pass out going through publicus thread its hughe and i made through like till april of 06...collected a lot of info and some good doc's///
only doc i couldnt find is the prose maual for texas...it would be great if some one could load it in this thread...

You can go to the court to get the pro-se package "better option" . Also my adivce meet the pro-se attendants...and get the process noted down. They are helpful here in NY not to assume they will be there as well. But hey!.
Get a pacer account and lookup cases in your district, it will help you with the process as well.

we have decided to go to the court house and file the suit this friday...life is a B****....hahaha sorry,its definitely bizzare a few years ago i was not so sure o moving out of my country and now i am partying non stop coz in less than 55 hrs from now i will be giving up my indian citizenship....
