need some info about conditional green card

hi thanks for google i found this website i have read some topics and answers were authentics to their problem so now i am going to describe my situation too actually i went to some attorneys and now i am like broke and may be i am thinking to go back to my home country i dont really know how to start...lol but i have to try.

i got married with us citizen girl in 2009 and came to us in july 2011 and we got gorgouse baby girl now she is almost 2 years i lived with my wife 4 month and i moved to difrent state and afer that we stopped talking with each other than i decide to bring my wife here at nc and i talked to her and she agreed to come and she came and live some time and she left to her parents home .
after than we had no contact with each other i try to reach her but no response.
now it almost 17 month in sepration and we both partner didnt apply for divorce i talked to some attonerys and they told me to get back to ur wife if u need green card else u need to file divorce and that taked 6 month if apply from CA if i apply from NC it takes 1 year in that period of time my green card will expire and i will become illegeal that what i scared now if some one face this problem before or have some good info plzz help me.
here is what dacument i have

wedding movie
pictures with wife and daughtor
airplane ticket
paycheck stamp sending her money...but she never with drwal
child support dacument.....but its defult not yet paying
home lease dacument...showing we lived in same appartment for some time
power bill

my wife is going to coprate with to file jointy i751 so what should i do know plzz help if some one need more info plzz email or ask here terbeladam@gmail.com thanks

What is your question? You have a baby daughter with your wife so barring anything unexpected, your marriage will be viewed as bona fide.

If your wife will not file the I-751 with you and your marriage is irrevocably broken, you WILL have to divorce her and get it approved BEFORE you can file for I-751 waiver on your own. So yes you will become illegal for a while, nothing anybody can do about that so file for divorce ASAP. As regarding, evidence, you do not need too much evidence of good faith marriage, your daughter is good proof. What you have is enough.

If she is ready to file with you, then there is no problem. That is the best, easiest, and cheapest option. For the sake of your little girl, if at all possible, try and reconcile with your wife. Marriage is hard but you have to give it your best effort. Good luck!

Do you understand what I wrote? What other questions do you have? I advice you get a lawyer to navigate through the waiver if it becomes necessary. Your grasp of the English language does not encourage me to suggest you go through the filing processes by yourself.

thank u soo much for ur prompt reply,now i have only 5 month left to my green card to be expired and north carolina law take 1 year of sepration for divorce and CA law take 6 month divorce and i dont know how much divorce lawyer will charge me for divorce case....
and to be honest i dont want give her divorce so is there any way i can apply in sepration with out help also i am trying to reach my wife may be she agree to help me thank u much
 
So you are contesting the divorce? If you reconcile, you both can start residing together and she can sign the I-751 when you file it. Else you still need to file your I-751 with a request for waiver.
