I have applied for I-140 and I-485 @NSC (NIW) last year in July. As like many others I haven't heard anything about my application though there were two updates last month (4/16/08). But because of some personal problems I might have to go back to India in couple of months. My question is:

1. What happens to my application if I leave and both I-140 and I-485 are pending.
2. If my I-140 gets approved before I leave will I be eligible for consular processing.

Please give me your suggestions/advice.

1. The I-140 is not affected. The I-485 will remain pending as long you have applied for advanced parole and the AP is still valid. Once it expires the I-485 is considered abandoned.

2. Whenever the I-140 is approved you can do CP once your PD is current again (could take a few years for Indian nationals).
