Need Some Help Please!

I am asking on behalf of a friend so I will try to give you all the facts.

My friend is married to a USC but they married in the UK while he was still at school there, however due to family ill health they both came back to the US but his problem is he can only stay for 90days at a time & then has to go back to the UK.

He is due to start school in the US in May & has job offers(he thought his Green Card would have been issued while back in the UK in the last couple of weeks).

Now USCIS are asking for more info, ie: more photos.

They have not hired an attorney as he has no EAD or AP so they do not have much "free cash" to spare.

Can anyone advise me on this so that I can relay to him?

so, did he apply for AOS or consular processing?

did he apply for AOS while he was here on a visa waiver?

did he apply for an immigrant visa and then come here on a visa waiver?

as he has no EAD or AP so they do not have much "free cash" to spare.

if he applied for AOS, why didn't he apply for EAD andAP?
