Need some help on apply green card for my parents

Hi,

I am looking through USCIS website and I am confused. I am currently applying for citizenship and I just passed naturalization exam. I want to have my parents to immigrant here. Instead of having them wait for a long time outside the US, it will be a lot better for them to get their greencard if they are in the US. They are now holding a tourist visa and it will expire in June 2013. Can I ask them to come into US first and apply for I 485 and I 130 for them? Will it be a lot of trouble if I already become a citizen at that time? If yes, are there any alternative solutions?

No, they cannot enter on a tourist visa with the intention of immigrating while here. That would be visa fraud.

You just have to file I-130 for them after you get citizenship, while they are abroad. Yes they will have to stay outside the U.S. for a while.

Theere is nothing that prevents them from entering US as visitors if at the time of entry they do not intend to seek permament residency. However, after once's entry into US circumstances can change and one is allowed *legally* to seek permanent residency once properly admitted into US. An immediate relative of US citizen can file for adjustment of status along with I-130. Be prepared to answer the question "how and when did the applicant decide to seek LPR status" during I-485 interview.
 
If you delay the citizenship ,it will take even longer. US citizens have priority for their family and that is the fastest way. I 130 takes at the most 5-6 months.....these days even 2-3 months. And that is the right way to bring your parents over.......consular processing.
