Need Some Guidance

Do you mean procedures for....?
1. bring your sister's husband?
2. bring you to the country?

Check www.uscis.gov for further information.

She wants to file for him for his green card or permanent residence from India.
My sister is USC and she is coming back on March 1, 2008 but we want to make sure all the filing is done before she comes. We want to bring him from India to USA based on marrying a Citizen Girl. any other ideas you have other than going to USCIS.GOV.

3 options.

1) If the US citizen has been residing in India for 6+ months, then you can apply for the spouses visa directly at the US embassy in India. This is called Direct Consular Filing (DCF). This process usually takes about 6 months, though the US MUST have been residing in the consular area for a minimum of 6 months.

Heres a guide indicating the steps required for this option

2) If you are not eligible for the first option, then you can go the CR1 route. This process takes about 10-12 months. Though this takes longer, the spouse will enter the US as a Green card holder.

Heres a guide for CR1

3) The final option is K3. This visa takes slightly less time than CR1, but thats the only advantage I can see with this visa over CR1. Until recently, K3

Oops. Pressed post before I was finished.

Anyway, as I was saying....K3 used to be the main route to bring a spouse to the US, however, CR1 has sped up immensely and now offers more benefits. If you enter the states on a K3, you have to go through AOS which takes time and money (3+ months without a greencard and the cost of $1000+ for AOS process). With CR1 you dont have to undergo AOS as you automatically become a green card holder once you enter US at POE.

Heres a guide for K3 anyway.

Good luck
