Need some good advice

PD April 99, I-485 ND dec 2000. EAD expire Feb 2002
My project is going to end in one month. If I go on to bench, the chances are, My company may cut me. The following are the questions I got. If somebody in the same situation or know the solution for this problem. Please do advice

1) If I switch the company, what should I do ? like paperwork etc..
2) Should I use EAD or file a new H1 to switch jobs ?
3) How long will it delay my GC process, becuase change of employer ?
4) Can I get EAD extension without any problem ?
5) How can I ask my company to keep me on the payroll with out paying ?

My opinion/s

This is purely my opinion from my observation.

1. Dec 00 ND may atmost take 2 months, this is my guess. I believe yours is in the first week of Dec00. So the best option is to stay with the present employer, without pay. YOu can take leave without pay, that is allowed, I guess.

2. Second thing what you can do is find a job , you can get a job, using your EAD. I don\'t think you need any new H1( as long as present employer keeps your job, without pay.). In this way you can have some money to live and fight the struggle.

3. Last option is to change the employer, altogether. I saw one case in this board itself, one guy who got RFE, sent two paystubs, both from previous and present employer, got 485 approved( Don\'t ask me the URL, I guess it is between Apr - July). Since there is already 180 day rule, to back you up.

These are my opinions only. Take lawyer advise.

Try to be with same employer for another 2 months. Hopefully you should be approved by then.

Use EAD.

Should not affect much. We have seen cases approved this way. After changing employer some people have informed INS about this ..that they have changed jobs with similar classification.

4) Can I get EAD extension without any problem ?
EAD extension is usually not a big problem.Do it by Oct-Nov.

5) How can I ask my company to keep me on the payroll with out paying ?
Take leave without pay or find another job with same classification (with current scenario this may be difficult).

Thank you very much, GC_WAITING and FRUIT.

The only thing I was worried is, if it gets transfered to the local office or RFE\'s, it will take a while for the approval. In that case I am planning on taking up a new job.

When I go for EAD Extension next year, INS don\'t care which company I am working for ?
