Need some assurance

Hi All,

I am GC holder (Work based GC) since Dec2004.

Due to some recent conditions I resigned from my job.

1) Will this cause any issues when I become eligible for Cship in 2009?
2) Do I necessarily have to find a job in the same field as the one in which I got my GC?

Please provide assurance.

1. This WILL NOT CAUSE any issues during your citizenship application
2. You DO NOT HAVE to get a job in the same field based on which you got your GC.

When a person gets an employment based GC, the USCIS expectes that the company ("the sponsor") will keep the employee ("applicant") for a good amount of time since the basis of EB GC is that the sponsor will keep the employee as a full time employee. According to Rajiv Khanna and other experienced folks, ONE year from the date of getting a GC from an employer is a good amount of time to leave the employer & find another job.

Having said that, if you have left your sponsor within a year of getting your GC (which is not in your case, right?) you MAY find probs/questions during citizenship process. I think you should be okay as you left the employer after a year and half. Tell me if my understanding is wrong.

I have been with the employer for about 18 months now...
I still am in a shock to have lost my job :mad: - I can't seem to think straight...don't have the strenght to worry about what happens to Cship many years from now. :(

Yes..I certainly will get a written employment verification doc.

In addition to that are there any other documents which I need to collect from the employer, which I may have to furnish at the time of Cship?

I have never bothered to look up the Cship application form so far (considering my situation where I won't be eligible for Cship until Sept 2009). Please advise if I need to get anything else from the employer?

I don't think of any document other than the experience/reference letter(s).
Since I haven't gone through the C'ship process yet, I may not know EXACTLY what is required from the employer.

Posting it under "US Citizenship" Sub-forum will be a good idea.

Trust me... If I were you, I wouldn't worry about the situation or the documents from the employer (other than exp/ref ltr ofcourse).

Why does it have to be the same field. I was under the impression that after you get the GC you have the right :"To be employed in the United States at any legal work of your qualification and choosing." - refer USCIS website 'Now that you are a permanent resident'
 
OOOPS! I really need reading glasses :( Sorry about that.

But I also want to argue the what that JoeF and others have posted, quouted, and re-quoted regarding the time you need to stay with the employer after you get the GC.
Under the AC21 portability if it is ok to switch after the 485 has been pending for 180 days why is it not ok to switch once you get the GC?
 
Not sure if there is any rule about when to quit

I believe all opinions given are only guidance and not rules by USCIS. I switched two jobs so far after GC with the first one 15 months after GC. I dont think there is anything to worry about.

What happens if the company lays you off after few months of getting the Green Card ?

I guess you feel "Very Blue" ;)

the approval, then the employee SHOULD get the letter from the Company
on the lay off and preserve any other document that forced the employee to get laid off. For eg, if the company gets into a merger OR gets into financial problem etc, the employee should obtain anything that can substantially prove that the company laid off due to a valid reason.

Some six years ago, the company that I worked for, laid off all its employees due to a merger. During that time, a couple of guys got through their GC process and gotten their cards just a few months before they could be laid off.

They got letters from the HR that they were getting laid off due to a merger and they got press clippings from the website and from some business magazines (it was a publicly traded company). They preserved all docs and recently applied for citizenship. One of them got through the N400 process and the other is waiting on name check.
