Hi All
I am writing this post after I talked to my Lawyer(Murthy).

I am working for Co. A for last 4 years and started my GC Processing in Sep 2000 at VSC

My I-485 RD is 01/28/2002
ND 02/14/02
FP1 05/12/02
RFE 09/23/03
RFE Response Rcvd 10/27/03

No FP2, but looks like I am going to get one
The client I am working for is forcing me to join them and my Co. A doesn't have any problem with that as they have other consultants working here.

Scenarios:
1) Change immediately and file for AC21
2) Wait for approval and then join (Max I can wait is Feb 15th as thats the deadline for client HR Dept)
3) Change now and not file for anything

My Lawyer suggested me for (1) as they think thats the most legal and safe decision.
What do you guys say??

Also My Job title is simmilar, Processing center is VSC, Work location is also same NJ/NY, however parent co. was earlier based in Boston and now new is in NY
Also my new Salary is 5-7% more than my current base Sal+Bonus
and If I just take sal difference its 20% more
So Idea is if I compare to last year W2 its 7% difference, but on employment letter it woulr be 20%.

Client is very cooperative and understanding, but they do have their limits.

Suggestions are welcome

Change immediately because if you wait and by that time your GC is approved then I think legaly you have to be with your sponsoring company for atleast 6 months. Moreover, you have already replied for the RFE which means its a matter of time before you get the approval letter in mail.

GOOD LUCK
