Does the consulates do the employment background check during CP. When I applied for my first H-1 after completing my MS here, I showed some experience which I didn\'t have. Also, there is some address/phone # typo\'s in the experience letter for that position. What are the chances.
I applied for GC under EB2/Masters.

Consulates are more concerned about the ability of the employer who is sponsoring your GC. However, if the purported experience was used to build your labor certification case, it may constitute fraud, and that is a potential reason for consular refusal.

Using a job experience for H1 is different from using it for GC labor certification. So check with your lawyer to see if it was used in GC labor certification. As an aside, it is never a good idea to pad the resume. You never know when it might come back to bite you. Then again, we are here to share GC related knowledge, so let\'s leave this issue for another forum. :)

While this may be fraud, I think consulate will never find out.
I don\'t know that they do background check, they probably rely on INS to approve I140 and on DOL to approve LC.

Check yur labor application (am not sure the form no\'s) there u must have entered all the work experiences for u to qualify for getting labor...if yur experiences are not mentioned in labor application then it should not be a problem at all...but if its in labor application then u have to have experience letters for those employers which i am sure u must have had as u have to submit it for I140 application else it wont get approved ...what the consulate has is copy of yur labor application thats where all yur experiences are reflected ..so if its not there then absolutely no need to worry....

I did\'nt have to submit any ref or experience letters for
140 or labor. but still got them approved. Though i did not do
anything like timeout.

I did put that experience in LC application.
Does the consulates get only approved LC application along with approved I-140 petition or do they get all the experience letters that go along with these applications. On the LC or I-140 application, there is no mention of phone #.If they have those letters,then they can verify by calling but the #\'s are not correct. The address on the letterhead of that organization does not match with address of the same organization put on LC or I-140 petition.
Really, this mistake is haunting me now.
Also, my EB2 LC is based on Masters, not on experience.

You have to stand by what you have written on your application. You have to play through the lie now.
I think Consulate just gets the LC approval letter from NVC and not all the paperwork that you had submitted. Logically it would be a waste of time/resource to keep transfereing that paper application and supporting docs from DOL to INS to NVC and to consulate.

Be confident- your case is based on Masters and if you have a legitimate degree you will be fine

As I said before, I think nobody is going to find out now.
Consulate is not going to ask you and they are not going to call anyone. FBI check is the only thing they may do to find out if you are a criminal (it is very unlikely that FBI is going to call anyone too).
The small likelyhood of anyone ever finding out is further diminished as years go by.
However, if anyone is going to find out, even years later, I would not count on your Masters claim. You misrepresented yourself and committed fraud.
