We got our passport stamped recently and are waiting for the plastic. In the mean time my wife got pregnant. We are thinking about where she should deliver the baby, here on in India. If we have it here, with the one month restriction on the visitor visa, we wont be able to bring my in-laws for helping us.
1. If we have it in India, will there be any problems in bringing our child back here (due to the fact that we have a GC and our child will not)?
2. My wife will be staying in India for more than 6 months ( 2-3 months in 2002 and 3-4 months in 2003). Will this pose a problem when she comes back as she has stayed out of US for more than 6 months?
3. When my wife comes back, what are the documents that will be needed to bring our child back here?
4. Is there a way that will let my in-laws stay here for more than 3 months on visitor visa?

Thanks in advance for the replies from the experts.

File for extension

At port of entry you can explain the situation and the immigration officer could give more than one month stay. Or apply for extension if only 1 month is granted. After a month depending on the health of baby and mother they both can go to India. Otherwise delivery in India may not be covered by insurance from here, think about it.

Advtgs in having baby in US

> 1. If we have it in India, will there be any problems in bringing our child back here (due to the fact that we have a GC and our child will not)?

You will have to sponsor baby if born in India. As GC you might end up waiting 3 or more years.

> 2. My wife will be staying in India for more than 6 months ( 2-3 months in 2002 and 3-4 months in 2003). Will this pose a problem when she comes back as she has stayed out of US for more than 6 months?

Your wife can stay in India for more than 6 months by getting a re-entry permit which can allow her to stay out of US for 2 years.

> 3. When my wife comes back, what are the documents that will be needed to bring our child back here?

Dont know if there are visitor visa required for infants. Another point to note is that many countries are now asking infant to have separate passport instead of being added to the mother\'s passport.

> 4. Is there a way that will let my in-laws stay here for more than 3 months on visitor visa?

Yes it is possible. At port of entry you can explain the situation and the immigration officer could give more than one month stay. Or apply for extension if only 1 month is granted.

I am not an expert, but I think

That you are making your life harder than it should be, unless this is a frivolous post. Anyway, have the baby here and get a passport quickly, get your wife to travel after baby gets the passport. Your relatives can easily stay more than 30 days, they will just have to justify why they need more than 30 days, go to www.ins.gov and read what they say about the new measures. So they could be here to help in the immediate time after and before giving birth. If you do as I say your son/daughter will have american citizenship automatically and it will simplify your life a lot.

Otherwise go and talk to a good lawyer.

My 2 cents.

JoeF,

Where did you hear/read that?
I thought that the baby doesNOT get GC just by travelling with the mother on her first entry to the US after giving birth.
If what you said is true, then it seems there is no need at all to have the baby born in the US. People consciously decide to have it in US to make sure that the baby gets gc immediately

Please clarify so as to make sure that people are not going off off wrong info

No Title

>People consciously decide to have it in US to make sure that the >baby gets gc immediately

The purpose is to get the citizenship for babies immmediately.
If you decide to live here permanetly, there is greater
advantage in having the citizenship than in having only
the GC.
