Since, I have already completed 180 days after filing my I-485, I am thinking of changing my employer using protability law. But, I have following questions.
1) To make sure my appointment letter from new employer reflects the same/similar designation of what is mentioned in Labor filing, I need a copy of it. Right now I don’t have one. And my company has their own immigration department with lawyers. So, requesting for the copy after I leave the company may not be helpful. Is there any other way that I can know what’s filed with DOL?
2) After changing the job, if INS sends RFE, would it send it to me? If so, to communicate with INS thereafter do I need a lawyer? Is it possible to proceed with the processing from that stage through a different lawyer? And do I have to get all the documents from the old law firm which may not be possible since it is owned by my employer I guess.
3) After switching the employer using AC21, if I get married before my GC is approved, is it still possible to include my spouse in the processing? If so can I do that through a different law firm?In the same way can I renew my EAD and Advance parole?
4) If at all anything goes wrong by switching the employer now, what worst could happen and what’s the legal remedy for that? I just don’t want to loose the luxury of working using EAD.
5) Right now I am working as a W2 employee (salaried employee). If I switch the job can I work using 1099?
