Hi Friends,


I am working with an employer(B) from past 3 months. I moved to this company from a previous company (A). My H1 transfer petition got approved 3 days before.

Since the current employer (A) is not good and supportive i searched for an another opportunity parallely and i have to join them in the 2nd week of September. They will be filing my H1 transfer from Company (B) to new company (C) in the 1st week of September.

Now since its just 3 days i got approved with H1 i am not sure whether i can enclose the approval notice of h1 transfer from previous employer(A) to current employer (B) as part of new h1 transfer petition process with Company (C).

What will be the reaction by BCIS if i don't enclose the approval notice along with H1 transfer form. Also what if after leaving the current employer he doesn't give the approval notice all and if BCIS raises a query to enclose that approval notice?


BCIS Online checking status and Phone checking status clearly mentioned that my case has been approved.


Friends i need to handle this situation very shortly. I need help from you all.

I don't have photo copy either because BCIS approved my case just 3 days before. It will generally take 2 weeks for employer to receive the approval notice from BCIS.

In that case is it advisable to file H1B transfer with receipt notice and start working with new employer. Then after the current employer receive the approval notice i will request it and keep it. If at all BCIS raise and RFE about that info. i will answer the RFE with the approval notice.

But my question what if the current employer rejects to give the approval notice since i will be leaving them. How can i answer the RFE that time.

Will BCIS check the approval status by typing the EAC no. on the receipt notice and see that it is approved, get the new H1 extension period and new I-94 information etc or will they request(RFE) for copy of approval notice.

This is the major concern i have.
 
I think you applied for H1-B extention. That means you already have one H1-B you currently working. So use the same H1-B.

I don't think BCIS will have time to check this kind of detail. It's only matter of waiting another 2 weeks. You can go for premium processing using new one.
