Hi everyone,
My wife applied for h4 visa and got refused few months back when I was with company A. The chennai consulate gave a letter to her saying that 'prove principal's status'. My h1 or my I 94 never got out of status. Right now I've been hired by company B. I have NEW valid H1 with I 94, through company B. Now I want my wife to apply for H4 on my new h1.My question is what docs I have to provide, If they ask for my status again?

Chennai is probably looking for an ORIGINAL and current I-797 approval notice for your H1B. Did you not submit it along with her H4 application?
 
I submitted all of the documents what the consulate asked for.They asked for only copies of I-797,I 129, my bank statements,my employers bank statements, my employers annual reports spanning three years,my w2 's for all three years of stay and my employer's w2's also. All indicated should be copies. My old employer is a body shopper and did a good business.Now that company has ten employees.
 
Although the general requirement are copies, I suspect that your company B transfer was in progress when your spouse applied for H4. Otherwise why would they want proof of employment.

I understand the frustration about "they asked for copies, now why the heck they are asking for additional evidence". But that does not work with DOS. if they ask additional evidence you provide them. period.
I suggest getting all BCIS related docs certified(I797 approval, I797 receipt, LCA etc), original letter from current employer(salary, a para about the h4), I129.
Your employer can provide the requisite statements in a sealed envelope and a cover letter.

You got to approach this problem with the attitude of how I can solve this, not with a lament...:)
 
i think you need to submit the whole h1 application package(original&copy - offer letter, LCA, I129, experience letter, etc.) along with approval notice (I797 original&copy). You also have to submit your degree & employment letter along with photographs of your company from inside and outside, and directions to your company from a prominent location. Though they may not ask, its better to submit tax return for the previous year and W2 along with bank statements and pay stubs. When you submit the copy of your passport, submit copy of all the passport pages along with I94 (front&back). I hope your I94 was valid when you submitted it.

Thanks to all for responding. The h4 refusal was on may 28 th 2003 and my H1 through company B was submitted in June 03 first week and got approved in june second week.
