Hi,

I had applied for 140 via New York in Jan 2006 with tax returns from 2004, we had an RFE stating that they wanted tax returns for 2005 by May 21st.
Now, I work in a small company and I am sure they are nor going to file for their taxes atleast till April 2006 (for the year 2005). Cant hep it.

My Question:
Say they reject this I140 Petition. Then can I use the same labor(if the 45 day rule does not pass) in May 2007 with tax returns till year 2005 and see whether I get an RFE or may be by luck just pass through.

The basic question is : With the same labor can one apply for I140 more than one time in case the first time the case gets rejected due to insufficient papers.

Yes, one can apply more than once if there is any new information in hand which was not there during earlier application.

But push your company to file taxes earlier or ask for more time from USCIS to reply to the RFE. talk to your lawyer.
