Dear Friends,
I am a US citizen and I applied for my parents for Green Card. At the time of application and approval my younger brother was under 21. After I got the approval notice they ask me for the visa processing fee and affidevit of support documents, and I provided that in timely manner. They send me some RFE notices, which prolong the case and my bother became 21 years old. They send the interview dates and there was no mention of my brother's name in the interview.
Now, my father is here in the USA, and we are all wondering what to do about my brother situation. I thought someone will help me understand the real law about such cases. I dont know, if at all even this is possible to sponsor my parents with brother at the sametime or not. As we all know, that if I sponsor my brother seperatly it will take 11 years please help me in this regard. I will be very thankful for any inputs in this matter.

When a USC sponsors a parent, derivative beneficiaries are not allowed. So you can only sponsor your brother directly in the sibling category (4th preference); he cannot be added as a derivative to your parents' applications, regardless of his age.
