Need Help With DS 156 related to F1 Reinstatement

Hi,

I'm a F1 student who has been reinstated recently in the US.

Now that I'm back in Poland, I need to renew my visa, and currently filing DS 156 form, there is one question I'm not sure how to answer correctly. If you can give me hand here, I'd be in your debt.

Question 38: Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

I overstayed without no-fault of my own (My attorney did not file papers on time )

Now should I answer YES to this question or NO ?

Again I was granted reinstatement in US. Is my reinstatement treated as a weaver ?

If you could clarify this questions I'd really appreciate it.

You should answer yes. Even if an attorney messes up, untimately the status holder is responsible for maintaining his/her status.

I actually wanted to know that question 38 says

"Question 38: Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?"

"been unlawfully present in" <------ thats me but I wasn't deported or violate any other rules and I got my reinstatement back when I won my case and I am currently studiying in a university in USA as a F1 student after my reinstatement ( don't count that I am in poland visiting my parents right now ). How it will affect answering "YES" to this question when I go to consulate for my visa to go back USA ? It is a online form to fill so I can't attach a file document and say "Look ! I was reinstated because of this that e.t.c" I am affraid that they will not give me my visa back and that is the question I am trying to figure out. Any help, experience would help.
