Hello Friends:


We applied for my MOM for extension of stay for another six monthas (B2 Visa) in May and received the receipt notice.....and wondering when we can get the response. How long the process is taking for B2 extension ?

Is there any issues if we don't receive the response before departing from US since the existing I-94 will be expired?

Here is something that you should be very much aware of:

1. There will be no issue if your mother gets an approval for her extension of stay even after the I-94 expires. Since, your mother has applied for extension she can stay till the decision is taken. If the decision is positive then her total stay will be considered as legal stay.

2. In case her extension is not approved, and she stays back over the I-94 expiration. Even if you receive the decision after the expiration of her I-94, her stay after the date of expiration will be considered as illegal. In such a case she'll have to leave the country immediately and will have problems while applying for visa in future.

So this is a gamble, usually the extension process takes between 6 to 8 weeks (my knowledge might be old). Please check at the Murthy dot com for the specific timeframes. Otherwise, you can check BCIS site for the status of the case, it should display the time it takes to arrive on decision in such cases.

The receipt notice says that it is taking between 30-165 days.


My question is that in case we don't receive the decision OR not approved for extension:

Is there any issue while departing ? For any questions OR concerns need to be prepared.

There should not be problems at departing as long as your mom hands in a copy of her old I94, receipt of the application to extend her visa.
 
Hi,

I have also applied for and extension of visa for my parents. The information I was given is that as long as you have the receipt notice from BCIS/INS, the person's stay is comsidered legal. Even if they were to be rejected, they would be provided a date by which they should leave the country.

But for sure you should have a copy of the I94 and the receipt notice dated prior to expiration of I94. This you should show upon departure and also keep for future reference.

We applied in March, and we still have not received a response.
