Need help. Requesting evidence I-485

Me and my wife have filed I-485, I was born 1968 and I do not have birth certificate and even
my dont have the birth certificate. So while filing Green card I had attached the
notarized affidivits which was given by our sibblings. Yesterday I received
the yellow letter from USCIS stating that they more evidence by getting a letter
from the governmental officer stating that the birth is not registered.

How to get that? Both of our parents passed away and my sibblings and my wife's sibblings
are here in USA. Is it is easy to get it from here? Is there any sample letter available? Please advice.
 
Contact the nearest US-located consulate of your country. They may be able to assist you to obtain the certificate from the issuing authorities (if the registration exists) or obtain a letter of non-availability (if it doesn't exist). If they can't help you or tell you who can help you, you may have to go to your country personally or pay a lawyer there to do it for you (if they would allow a lawyer to obtain it).
 
Simple Process

If your Birth is not Registered.. then ask any one of your relative to apply Birth certificate at your applicable local Panchayat \ Municipality\Corporation office(Which ever applicable). They do search on the records based on your application and issue NON Availability Certificate.

Along with Non Availability Certificate, Affidavits are Valid.

Also your countrys local consulate can issue Birth Certificate based on your Passport. but some times USCIS will ask again Non Availability Certificate.

USCIS Accepts Non Availability Certificate+2 Affidavits from relatives and date of birth, place of birth should be same as on passports and should state relationship with you and your father/ mother. if from india one should get Affidavits on stamp papers signed before Notary public.
**USCIS don’t accept birth certificate from Indian consulate that is based on passport info.

I was born in a village and my wife was born in town. My father got a Non-Availablity Certificate from the Tahsildar. Is USCIS would accept non-availability certificate which was given by Tahsildar? On the letter it shows Office of the Tahsildar stamp and signature. Or I should get it from MRO. My father is saying that MRO is now called Tahsildar in the new government, is that is true?

And I was also told that my wife would get the non-availability certificate from the Municipal Commissioner. Is Uscis would accept that?

Please advice me. There is not that much time left over. Any quick response would be appreciated.

If you were born in Village then the Non-Availablity Certificate may be in Indian language. ask your father to get it translated in English from Notary on stamp paper and Notry will put his seal and top write TRUE translation of Non-Availablity Certificate . you need to send the COPY of Non-Availablity Certificate (that may be in Hindi,Punjabi, Gujrati,Telgu, Tamil)+ Copy of English translation+ 2 affidavits .Originals you should keep with you.

Village Panchayat also keeps record of Birth and Tehsildar office can also keep birth records and District registrar also keep birth record that is sent by Village panchayat to Tehsildar or registrar and it all depends on Indian state. Tehsildar is also executive magistrate and in same states of India. USCIS accepts documents from village panchayat/tehsildar/Registar and Municipality.

Another problem on the typed Non Avaialability Certificate.

My last name Chenna and first name is PrathapRaju, but on the letter it says as
Chenna Prathap Raj, there is a space in between PrathapRaju, on my passport there is no space, even my parents first name has same issue on the letter. My mothers first name is SubhaLakshmi, but on the letter it says Subha Lakshmi.

Is this would be a problem? Please advice. Do I have to redo the whole certificate again?

Name should be same as on your passport, your I-485 form and same on affidavits and on non-availability certificate. Get is corrected. Your father should give “Chai Pani” to clerk in Tahildar office so he can type it correct and again clerk can get the seal and signature of Tahildar.
Affidavits should have your correct name, DOB, father name, place of birth, mother name and on stamp papers signed before notary or executive magistrate.
 
Everything looks good other than space in the first name. Oh God, the government offices already made my father life so horrible and again just to fix this space I think they will take forever and no that much time left over. Even space in the name matters.

Few days’ back one of my friends had interview for his I-485 in local USCIS office (his file was transferred to Local office). His full name is Ramesh Kumar Sharma. First name Ramesh. Middle name: Kumar and Last name: Sharma. His passport has the same info and his I-485 form that was submitted had the correct info. On his marriage certificate the clerk in India typed his name as: Rameshkumar Sharma(no spcae after Ramesh and Kumar) and he never checked that the name does not have space after Ramesh. Officer told him that he should get the certificate with correct name with spaces. In North India they write name as Ramesh Kumar Sharma but in Maharashtra or Gujarat the clerk will type Rameshkumar Sharma so one has to tell them what is correct.
 
Ok, in this case I am back again in this Non availablity Certificate loop. I am very positive my father will be shocked to know that he will be going back to the Tahsildar office tomorrow first thing in the morning. Thanks Ginnu. Thank you very much for all your responses.

But the problem here is when I submit the I-485, I have attached one Affidavit from his mother stating that her birth is not registered. And now the municipality office is saying that the birth is registered.

1) Can I submit the Birth Certificate?
2) Since I have already sent a affidavit saying no birth registry, and now after RFE if I sent the Birth Certificate, is that would be a problem.

I am totally confused. Please please reply very quickly, because there is no time.
 
Can I write a letter to USCIS saying that after doing research we came to know that the birth is registered? Very confusing. Please reply.

----------------She can write a note that her parents did not remember if her birth was registered when she sent I-485 and that is why she submitted affidavit with her I-485 but later one of relative told that her birth was registered and then her parents approached municipality and asked the municipality office clerk to make a search and found that her birth had been registered and then got the birth certificate.
Very confusing. Please reply.

------------She should write the note and she need to Sign the note with her name her pending I-485 reciept# and her A# at top.. OR dont send note and just send what is asked in RFE letter and if they ask later why did she sent Affidavit earlier with I-485 then she can explain. I think they are not going to ask. Just send what is asked in RFE. Any document that is in Indian language and is not in English get it translated by notary in India on stamp paper (stamp paper makes a difference to them).
