Need Help regarding AC21

Here is my situation. Mine is a Labor Substitution case. My company applied for I485/I140 using already approved Labor of someone. I got my I140 Approved last month.

1) Since my I140 is apporved Can I use AC21?
2) I checked with the lawyer and he said that it is very risky to shift a company without having completed 6 months after I140 is approved. I don't know how far this is true.
3) I don't have the copy of the Labor certification? I have asked the company for whom I am working now and they refused to send a copy. Can I join a company without the copy of the LC? I have a copy of approved I140 but it doesn't have job description in it.
4) I didn't get my finger print notice yet. If I change the company will it effect the finger printing process? If I join a new company, does the notice go to the old company?

Any input is appreciated.

2. Your lawyer is a fool.
3. Use FOIA and get copy of your LC.
4. No. FP notice will come to you - just inform USCIS that your old lawyer is too old to handle your case - so you have decided to give him a break and enjoy social security benefits. Get another lawyer - fill G-28 - rest new lawyer will take care of.

Without LC approved copy, can a person file AC21?

How soon does he need to file AC21 once he starts employment?

I was reading posts yesterday - it is great to read others too.

LC apporval copy is not needed to file AC-21, however you need copy of LC to know what should the job profile be and what salary you should be looking at(minimum).

One should file AC-21 as soon as one can do it(do not rush unless your 485 is about to be approved.), if 180 days of filing of 485 is over AND 140 is approved.

What is FOIA? Can you please give me some direction to how to apply for it.

Just to add to that . If you get an approved LC notice that will have not have any job descriptions you need to have both form ETA 750 A & B which is where the job descriptions are mentioned.

If you use FOIA ask for underlying LC as well which will get you complete LC inlcuding ETA 750A&B.

Can't argue about it. It is as real as the fact that Manoj never cried, Junior B found WMD, that Aguirre speaks atleast one truth every year..., USCIS is working or even better atleast one person in USCIS is not sleeping... and so on... :D

GC7 Dont get caught up in these two guys they are having their own fun :)

Please go to the separate forum AC21 under 485 issues on this site and you will be able to find answers to all your / most of your questions.

Also consult a good lawyer and get his opinion about filing all forms G28, AR11 etc. Bottom line is dont waste time. Employers will not wait for you. If you have a good opportunity get it now.
