Some Backstory.

In April 2011 my wife and I filed forms I-130 along with I-485 and all the forms included. The petition was filed by my wife who is a U.S. Citizen by birth.

In May 2011, they asked for additional evidence such as our joint sponsors (her parents) W2 and proof of citizenship and my medical examination records.

Fast forward to now, earlier today I was pulled over for "improper display of front plate" and "loud muffler" which then lead to my arrest for driving without a valid driver's license.

My question is, will this affect my application for I-485? Is there a possibility of deportation even though I have the forms completed and filed?

USCIS received the additional evidence May 31st, my court date is on July 17th. What are the chances that I get my employment authorization before my court date?

Any help would be appreciated. This was my first ever offense.

Employment authorization is supposed to be approved within 90 days, so you should have it by July.

If you are a licensed driver and just happened to forget to carry your license with you, that is a minor violation and it's not going to cause your I-485 to be denied.

However, because you were arrested, you will need to bring the court disposition to the interview.

If you did not have a valid license at all, that is a serious offense and you need to get a lawyer. Actually 2 lawyers - a criminal lawyer to defend you for the unlicensed driving charge, and an immigration lawyer to advise you on the immigration consequences of whatever you plea to. If unlicensed driving is a criminal offense in your state, the court should give you a public defender.

I checked my status on USCIS for my Employment authorization and it says the card is being ordered. Does this now make a difference? Also all the police officer gave me was a ticket I don't know if it was charged as a petty offense or a class B misdemeanor.

It just means your employment card will arrive in the next 1 or 2 weeks. Doesn't make a difference to your deportability or lack thereof.

Were you issued a license, but it wasn't physically with you when you were pulled over? Or are you unlicensed? There's a big difference in severity.
