Need help please. AC wife has been out of work for about 3 years

My AC wife has been out of work for about 3 years now with that said she has not payed her taxes as a result. We have been together for a year and just got married Last month and decided to go forth with the GC procedure. I have been in this country for 5 years overstayed visa.. How would the fact she have not payed taxes in a while and does not have a job affect the procedure for the GC? I have an idea we may need a co sponsor or two, what are the forms we need to file to get things started? Any information and help on this would be greatly appreciated.Thanks

Yes, you definitely need a co-sponsor. The joint sponsor needs to fill out I-864 form and provide the necessary documents (such as: w2, personal income tax copies or IRS transcripts for the last 3 years).
 
Thanks for the reply and information. how long would it normally take to get a reply? Has anyone else in here gone through a similar procedure at least in the co sponsor part? Please share your experience.. Thank you

The financial considerations for a co-sponsor are great. The biggest issue is finding someone who will do so. The requirements are documented on USCIS site.

If your wife is unemployed, how is she surviving financially? The financial requirements permit the use of assets to overcome lack of income,
 
Concerned4us thank you for your input. My wife used to manage a firm so she has some money stashed away plus her relatives and my self pitch in if needed. I don't have a working permit so I don't work however i do small gigs time to time. I checked the guide lines and it seems we may need a co sponsor or two even with her assests. Is it common the co sponsor gets denied? if so what would we need to do if this happens? This site is a life saver.

Question when sending the forms in the 1st time do I also do the Dr check up? or do i have to wait till I am instructed to? I have been in college on and off so i have been vaccinated (immunized) already.

So I have to send out I-130,I-485,I-693,I-864,I-765 at the same time with the money orders right?

also the G-325A how many of these do i need to fill out? 3 or 2? I am a bit confused.
1 for my self with the I-485 one for my wife with the I-130? Thanks alot guys
 
Since she has assets that could be used to compensate for her lack of income at this time, review that part of the requirements carefully to see if that eliminates the need for a joint sponsor. Also, depending on the manner in which you are working, your income may be considered.
 
See my progress below. I think it's best to submit I-130, I-485, G-325A, I-864 at the same time. The rest can be submitted later (as soon as possible. Do not wait until they remind you) if you can't complete them now.
Regarding medical check up, even if you had all vaccines, you still have to do medical check up (it does save money if you have your vaccine record). You should contact the doctor asap. It took me few days to get appointment with doctor, and then a week for him to complete I-693, and then a month for my spouse to file tax returns (since he hadn't done it in the past 3 years) etc. It's unnecessary to delay sending important stuff (I-130 and I-485) for such things.

Every $5 in acceptable assets reduces the income requirement by $1.

Your income cannot be used towards the income requirement, because your jobs are not legally authorized employment. But the money you saved could be used as assets for offsetting the income requirement.
 
Wow alot of good information here Thank you Jackolantern and f1study I am finally seeing a much clearer direction now. I am going to mail in I-130, I-485, G-325A, I-864. One more thing I have been thinking about filing my taxes my self. Would that disrupt anything in the process since that my wife does not? I should be getting my ITIN any time soon and I have been contemplating on filing my own taxes since I know how to do it when I helped some ppl file theirs. Should it be joint a tax return?
 
I am going to look at this part over If it does come up to the amount It would make things way more easier thanks a lot Concerned :)
