The appeal can take you 2 years! Do not waste your time, or at least file another petition in the meantime (NIW and/or EB1-EA), better argued and may be with the help of a good lawyer.

suggestion

If you have so much time for your appeal, you should re-organize your application and submit a new application. I believe your first application was not good enough. Two of my friends got approval form VSC recently. It is not so difficult for NIW.
