I had a similar situation like sviv.

1. The domestic violence charge amounted to felony.

2. My lawyer got the DA to approve a deferred prosecution after I pleaded guilty on paper. There was no conviction and my case will be heard again on June 27th after I voluntarily complete anger management class. If I miss any of the classes, I will be reported to the DA's office and will then be convicted for the offense.

3. My lawyer said case will be dismissed on June 27th court date, if I fully complete the classes. And there after file for expungement from my records.

Johnny: My questions are.

1. Even though this case will be dismissed, will the fact that I did a "plea bargain" affect my citizenship application?

2. I am planning on travelling to London on company business on February 24th. Will I be held/detained or deported at the POE on my return if they see that I have a pending criminal charge on me?

3. Will I still be at risk (for deportation) even after the case is formally dismissed in court?

I just wanna give the guy here some hope. I know a guy who was a permenant resident and hit a police officer, and then ran away, only to find 5 police officers were waiting for him inside his house to arrest him, thats right, and he applied for citizenship, it took him 2 yrs in courts back and forth, and guess what, he got granted citizenship. I know he was lucky, but all am saying this life, ppl make mistakes, and even immigration understands that...so the point here, don't get too down on your self... but you best bet is to hire a lawyer, cuz u need to anyways..........remember it is what it is and you can't undo things, you just have to deal with it and have some faith.

Human beings always make mistakes. Some bigger that others. It's important that we all are aware when we're doing wrong, and try to correct the mistake and more importantly not to do it again. Also, doing good deeds is a proof of rehabilitation. Maybe your friend wasn't only lucky maybe he proved thru his ulterior actions that he is a new person, a good one. I hope so. :)

I applied for my Citizenship in Feb 2005 after completing 6 years of my GC, I had my Citizenship interview on 01/26/2006 and young lady officer told me she will mail her decision within 6 months. I didn't ask why she is not approving my application today. I do suspect one reason.

I was charged with Assault on Female and Communication Threats in Dec 2002. It was with my wife. We went to court in June 2003 and I received 12 months probation under the differed prosecution and voluntary dismissals. Court asked me to join change program for 6 months and put me under supervised probation for 12 months. I completed change program in Dec. My Attorney talked to DA and Judge to do Voluntary dismissals in Dec 2003 and probation end as well Dec 2003. Case was voluntray dissmised in Dec 2003 and I had expunged my records in June 2004.

Offense:
I Assault on a Female
I Communicating Threats

Offense code:
I 1389
I 5328

Offense in Violation of G.S
I 14-33 (C)(2)
I 14-277.1

While applying for the Citizenship I didn't attach all the arrest and court documents. I only attached the expunge approval notice from the court and did mentioned about the charges on the application from. I thought other document might not be required because case was dismissed and expunged.

After the interview lady officer asked me to mail certified copy of court documents to her within 30 days but I gave her right away. Even though I attached expunged approval notice she wanted to verify if case was really dismissed and I have successfully completed the change program. I did gave all the documents to her. After taking documents she said I will mail my decision in 6 months.

What are the chances they won't deport me and approve my Citizenship application?

I would really appreciate if you can advice me next steps. I would really apreciate your time and any valuable suggestion.

MY friend was arrested last year for sitting too long in restaurant .Case was dismissed in pre trial with him taking some counselling help from court appointed doctor .He was on 2 year probation.At the same time before 2 years he was again arrested for domestic violence but case was decided with deferred judgement and 6 months DV classes. Will this have an effect on his green card application. he is in 1st stage .what be can be done so his green card is not denied.Any inputs?
