Need Help Immediately!

Hi,

I have a valid Stamped Visa from My first Employer dated jan2003
now in between I switched my employer so my new H1 is valid till
march 2003.
I wanna go to india in november 2002 my present employer says he can file for extension only in December 2002 i.e 3 months before actual H1 expires.

Now i am dilema wether to go just now to india to get my passport stamped and then go back in november....OR to go in november and get it stamped at that time.

But my worries are if i go in november then it would be less than 6 months period of valid visa approval will the consulate gives me a new Visa at that time or should i take no risk and go right away and get it stamped.

Options

1. Per AC21 and DOS web site, you dont need a new stamp if you have a old expired h1 and a new I797 approval in hand. Just make sure that you enter new employer details in I94 while coming back. U can enter a day before the expiry of the current visa. TO show you are working for the new employer carry some recent paystubs or letter from them.

2. U can go for a revalidation stamp. There is no restriction, since this is a change of employer and not an extension. If you are talking about stamping after extension from current employer has been approved, without having an approval in hand I would not speculate.
When do you plan to apply for extension? My suggestion would be to apply for extension after coming back to US and before March 2003.
 
so you mean to say Revalidation Stamp does not have to depend upon 6 month
valid Work Permit?
as per my employer he says extension can be filed only 3 months before i.e
around 15 December 2002.
before that I have to be here.
But my worries are I am planning to go in first week of November 2002 and
immediately file for
Revalidation Stamp in bombay(i.e. after 6 month period which is after 15
September 2002)then
I dont wanna take chances with US Consulate back then.(although i would be
having all my pay stub,w2,employer letter etc)

Please help as I am new to all this stuff.

why do U want to do

a revalidation in consulate. If U are coming before march 03, U dont need a new stamp...
 
still having few doubts....

OK,I dont wanna take chance on port of Entry in USA.
But if I go for revalidation of stamp in consulate will they do it or not ?

what is your question?

Do you want to know whether consulate will grant you a stamp? or is your question "should I ask my employer to file early /late"?
Please state the dates (anticipated extension application, your visit date, current expiry date clearly)

Dates are :

anticipated extension application : December 17th 2002
your visit date to india : November 2 2002
date of reentry in USA: december 16 2002
current expiry date of visa on passport :january 4 2003
current expiry date of I-94(new employer):march 10 2003

Documents required to travel?(from my employer?)

May be you are slow or your are too safe

As jaxen says you don't need new visa stamp in passport if you have valid visa. but if you want to get new visa it shouldn't be problem with your new h1 apporval. show them new h1 approavl at POE when filling up i-94, so you will get correct information on your i-94 form.

One thing you can file h1 extention now whihc will be valid after march'2003 and get approval before you leave for india so you can get visa based on that approval.

And other thing you can get visa revalidation done at st. Loius which you are in usa. get more information @ www.immihelp.com.

You need employment letter, recent paystub, w2 form and all the h1 approval.

Hi Guys,
Could you tell me please which documents I should present in consulate in order to get H1 stamp in pasport. I'm currently on H1 for 6 month- never filled W2.
