Need help...Huband just became US Citizen..I am Canadian Citizen

Hi there all,

I have been going with this back and forth..still confused on what to do.
My husband just recently became US citizen. He had originally filed for my I-130 when he was a Green Card holder. Our I-130 got approved in November 05, but it was kept in backlog for NVC since my priority date was not current. As I understand my priority date will become current once my husband informs NVC of his new Status.

Now I wanted to know if I can apply for i-485 and come to US or do I have to with CP processing. IF I apply for i-485 I do not have I-94 will that affect anythng?

Your advice would be appreciated.
 
You have to be inside US in order to file I-485.
If you plan to apply for immigration from outside US, you would have to take the CP route.
 
Thanx for response...I plan to come visit again the after he becomes a citizen at this time can he then apply for i-485 for me? Will my intention for AOS have to be made to border control or should I just enter in as tourist ?

If you tell them, to the border, that you'll apply for I-485 they may not let you in!
Just come as a tourist and you'll decide after that what you'll do ;)

It is advisable to wait 90 days before you apply for I-485, because you stated when you applied for tourist visa that you don't intent to overstay or to immigrate in the US.

P.S. I don't advise you to lie, but if they don't ask you specifically this question, you don't need to volunteer it.
