need help for friend
in one of my friend case. There is mention of Similar Job title in his Labor (i.e in which area he can work). He told me that his main title was as Computer S/w engg. and in the column of related job title there was mention of Compu. Prgrammer/Analyst,Compu. Enng and one other.
He got another job as Programmer Analyst.
Also in salary part I think he is off from labor by 1700$ for year(i.e means current salary is 2.8% less then labor).

Would he be OK.
Job desciption he got is exactly same as labor might be 1% dif.
So what would happen in his case.
He wants to use AC21.
 
I would geuss he is OK. As far as I understand when they use AC21 they look at more than one thing when deciding on "same or similar" job:

1- Job title,
2- Job description,
3- salary range,

From your post all three seem to be rather similar to the original filling. Little diferences may be expected; this is why in the law they refere to "same or similar" not just "same" job.

Having said that, I understand from my lawyer that there are a lot of letigation in the courts for AC21 cases. Best for your friend is to consult with a lawyer to carefully review the wording. I remember reading on one of Murthy's chats, her saying that the wording is so critical.

Your friend should be fine. I had similar problems. I had a 45% pay cut in the whole year of my salary, I'm talking about my w2, which was around 45% less than what it was mentioned in my LC. Morehow my designaiton was programmer/Analyst but now when I got RFE(last 6 pay stubs, AC21, PP copies and BC), in the employer letter I've mentioned my designation as S/W Engg. and I've submitted only 3 paystubs from the current year and 3 from last year. But the BCIS didnot care about that. I guess BCIS will not care if u prove that u r currently having a job and u r able to submit your most recent paytstubs at the time of RFE.
