Hi everyone!!! I got the GC in april of 2002 (thru the lottery) and I lived in US until january of 2004 and came back to my country to finish college. I finished it in december in 2004, but since than I keep going to US every 5 months to not desrupt the residency, and some times I stay 1 or 2 months and some times I stay 1 week and come back to my home country. But now I got a job in my country as a crew member. The questions are:
1-Can I apply for citizenship? What should I do to apply to the citizenship?
2-As I have the GC but not living in the US will the IO let me in the US as a crew member without a "D"visa?
3-Can a GC holder have a "D"visa?

Just stay in your country. Your intent has always been that anyway. Us residency should not be a matter of luck that is what a lotto is. It should be earned and deserved.
 
Staying in the US for a week or maybe a month at a time does not make you a resident, and it certainly doesn't qualify you for US citizenship. I doubt you'd even have accumulated the minimum 900 days physical presence over the past 5 years.

If you truly want to become a USC, move back to the US before you GC gets canceled, and live here for 5 years while working on your eligibility.

Probably not since you have demonstrated you are not fulling the requirements of the Green Card nor the N-400

Not sure what a D-visa is, but if you have a Green Card you do not use another visa, you have a Green Card. The IO can determine and deny you entry if they see you are not fullfilling the requirements of the Green Card (residency) and revoke your Green Card if needed.

Seems like you have been in the US for nothing more than 1 or 2 months per year for each of the past 4 years. There is no way you'll be approved for citizenship, and you're lucky they haven't already revoked your card. Officially surrender the green card using the I-407 form and then you can get a D visa. Don't wait for them to revoke the card.
 
They really need to get rid of the DV lottery program and give those green cards to employment and family-based people who really want them.

I agree that they need to get rid of lottos in granting gc. Also many lotto winners come from very poor countries and are uneducated or countries that have bad relations with US. I differ that lotto gc should be awarded to employment based visas. Many companies underpay and overwork employment based workers. Cheap labor.
US should spend money in training and educationg its own unemployed workforce. There are more then enough smart and intelligent people here. And many are unemployed or underemployed. I say they should eliminate this employment visas completely. They take away jobs from qualified Americans. Moerever 45% of employment based visas go to country of India. They have cornered this market if you can call it that. Not only that they have outsourced jobs to the country of India. It is a double whammy. There are Indian companies bringing in people with dubious resumes and unproven qualifications. There seems to be systematic system exploiting and taking advantage of employment based visas. There are various widely available articles about this. The intent of employment based visas is temporary stay but they have allowed themn to apply for green cards which is totally agianst the original intent of employment based visa.

Yes - this makes perfect sense. They should also get rid of the family immigration visa and any asylum/refugee visas. And the wall they build on all borders should be at least 30 feet high and have a moat with crocodiles. To be sure, I would even wall of the coastline and then put a plastic lid on the whole country. Only then will you be safe... unless of course, someone burrows from below... hadn't thought of that...

Completely agree. You can say - I moved for college and maybe explain this that way but after 2 years, this begins to stretch credulity. The OP should reinforce his ties to the US and get citizenship or move back.

Forget about citizenship - your GC should be revoked! There are thousands of folks waiting who would love to have a GC - I just think of my adjustment process in 2002... you don't seem to be that concerned about being a LPR- Give it up... go home... and be happy!

I understand where everyone is coming from.

Remember America is a country of Immigrants..

There may be reasons ITT is in school overseas.

My advise is talk to a lawyer and see what he says.

On the other hand America is a great nation even during rough economic times.

Many people would appreciate what you have ITT, so to become a US citizen, you need to prove a strong tie to the US and prove you are part of this Democracy.

If you really feel you want to be a part of the U.S., then come back and stay here for 5 years (work pay taxes) and then apply for Naturalization.

Freedom is not Free, and even though i wouldt say seal the country from immigrants, I say GC and Naturalization is for those who appreciate and prove their loyalty to America.

A few days ago I was talking to an elderly caucasian gentleman and he totally unhappy with the immigration process and who is allowed and who is not. He mentioned that his son lost his project manager job to outsourcing which went to India. He mentioned that his grandson was made to train an Indian on work visa and then dismissed from his job of 6 years. He said the Indian replacement could not even speak proper English. He also mentioned that his Doctor has send his medical transcriptionist job to India.

So not only are American jobs being outsourced manily to India but 45% of Work visas are going to Indians.
Can you back up what you said. The wall on CA border is already helping to stamp the tide of illegals.

What are you saying about the lottery ? Because you are probably from a country that is mostly beneficiary of employment based or family based visas, you think that US should restrain visas to only people of your kind. I think this is a form of discrimination. I am sure if the US was full of people of your kind, you would not be here yourself. There is a reason why some countries are not allowed to play the lottery.

In countries like India and China, it is easy to get a student visa for the US. That is not the same in Africa, where the population is full of poor, but smart people.

If you think that lottery brings to US unskilled and cheap labor to the US, let me clarify that to be qualified for DV lottery, one has to have high school diploma or at least 2 years of work experience.

If you think you are a "Skilled and expensive" worker, then you should know how to respect people and promote diversity. That is what DV means (Diversity Visa). :mad::mad::mad::mad::mad::mad:

It is not easy to get US student visa in China.
Us is not the country to take care of all of World's poor and uneducated.
In africa only South Africa is developed and has a decent economy. Why can't rest of Africa follow south africa's example if they have smart people like you said.

Even if we were born or naturalized here we are all children of immigrants.

I agree with everyone.

1. we need to secure the boarders
2. The lottery program should countinue, but people should take personal responsibility to learn and spend time in America (appreciate the Status)
Reason is because others who really need GC and appreciate this country cant get it.

3. America needs to secure the Jobs here.

There are many reasons why Africa is poor, if you knew a little bit about history and international politics, you should know that Africa is poor as a result of slavery and imperialism that has helped developped western countries like USA and Europe.

I am sorry, but I think some people here are haters and may be racists ... By the way, if your country was such developped, what are you doing here ? May be you are the least skilled in your country....No one wants you there, so they threw you here because US is the place for all misery of the world. I have supervized many chinese, indians, mexicans etc.. and many of them cannot even write their names or speak english :D:D:D However, I have never considered them as secondary people. I have stood up for them when they get discriminated by fellow americans. I don't know if I will do the same after reading your posts.
I have always thought that some Americans knew little about the world, but you just proved that there are some fellow 1/3 world citizens who think they are more westernized than americans and europeans.

Johnny, I apologize for using such word. However, I think you should also warn people who use bad words to describe other countries. I think it is important for the well-being of this forum. Thanks :mad:

But that applies to all green cards except for retired people. Whether they get in via employment-based, family-based, lottery-based, asylum based, or any other basis, nearly all the adults who immigrate will have to get a job.
