Need help - Change of employer

Currently i am in Boston,MA and my company applied for 485 in May 2002 as a database administrator(DBA). My current project is ending this Friday. Yesterday I got an offer from a company in San Jose, CA as a Software Engineer. They agreed to add some DBA duties in my offer letter but they are not able to provide me the job title as a DBA.

Please give your valuable suggestions for my questions:

1. Is it safe to change the employer with similar job duties and without same job title?

2. Based on the current economy new company offering 72K, but my labor application was approved for 80K. Is this difference is Okay?

3. If I accept this offer, when I need to inform INS about my new employer? Some of my friends advising, it is better to inform before my old employer informed(may be he will inform) to INS that i am no longer with him.

4. If I change the employer, Is my case transferred from VSC to CSC? If so, is there any time delay in processing.

I think it is fine. Job duties have to be same, job title can be different. Consult your lawyer for the same as well.

Doesn't matter. Your new salaray just should prove that you wont be a public charge.

You can inform INS after you join them. Lot of people dont inform. They wait for RFE to do this. You can also do the same. I suggest if your ole employer is going to inform, then you should also inform (just to be on the safer side).

Final question....

Do I need to contact my old employer's attorney? My employer may influence the attorney against me.

Do we need any documents from Attorney or old employer???

Currently, I had copy of 1-140 approval, copy of I-485 application receipt and original EAD.

If you like your attorney you can continue with him/her. I am doing same thing, I am still using my old employers attorney.

If you want to change your attorney you are entitled to ask your attorney for your file. They should give you a copy of your whole file right from LC to 485 application. You have the right to ask for it.

I suggest first talk to them, tell them you want to continue with them, if things look good no need to change attorney.

You should ask for copy of your file even if you dont wanna change your attorney. Better to have it.
