Hello! I am an American citizen, and my boyfriend of over a year is a French citizen. He came to america almost 4 years ago on a student exchange program. He then filed for a student visa and started attending the same junior college as I was. However, he was no longer able to pay for his schooling after 3 semesters so he stopped going and his visa expired.
He did not leave the country though, becuase he was trying to find a way to get money to stay in school (ie family, loans....) but before he could find the money, he was arrested and "removed". He was held at a federal detention facility for 3 months, and then sent back to his country (Guadeloupe, an over-seas department of France located in the Caribbean). All he has from the immigration court is a paper that has checkd off "the respondent/applicant was ordered removed from the US to Guadeloupe or in the alternative to France.". And at the bottome of all the options to check, is other and they have checked that off and wrote "respondent advised as to consequences of illegal reentry".
While he was being held, i tried to get in contact with his deportation officer and was successful only once. She told me that he is banned from America for ten years! She said that's what happens to ANYONE who is deported. But reading online, I feel (as does my boyfriend) that she may have just said that.

My question is this: how do i find out EXACTLY how long he is banned? I'm currently staying with him in Guadeloupe right now, and if this is true, and he is banned, we're looking to go to back to school in France together, but he would much rather go back to America, as would I.

If anyone could tell me ANYTHING, I would be ever so grateful. I feel as though I have no answers, and no way of finding out.

Thank you so much for reading & responding!

Ok, you are leaving out some important details in order to get someone to better help or provide you with more accurate information. First and foremost when was he arrested and why? It's important to determine if he has a state criminal record as well. How and where was he picked up by ICE? How long has he been out of the country? You need to provide the exact reason for his removal. Your story sounds a little "imcomplete" to say the least.

He is banned from re-entering the United States for a period of 10-years without first obtaining permission from the United States Attorney General. Assuming that you two want to get married, you just need to do a waiver. Unless he is a big time criminal, it will be granted. To bring him to America to get married, you would need a form I-129, I don't recall what the waiver form is.

Sucks to be him. If he returns, he will be arrested. Your best bet, find a new guy.
Lets assume that he was allowed to return, a drug convict would get him deported.
Even if the charge is dropped, there will still be a record of the arrest. I'm not sure if that alone wouldn't make him inadmissible.

I'm sorry, but you are much better off withour him. He isn't going to give up drugs, and no matter what he told you, he wasn't arrested the very first time he had them in his possession.

I think your only other option is for you to learn to speak French.

The waiver form is i601. This is in addition to the "normal" forms you would need to try and bring him in as your husband should you marry.

However, I think you need the help of an immigration attorney at this point - it does not sound like a simple do-it-yourself case. remember That criminal attorneys may know little or nothing about immigration matters.

While I'm grateful for your input & advice, I'm also repulsed at how fast you are to JUDGE somebody you know ONE little fact about. I'm not going to sit and argue about my boyfriends character becuase honestly you're OPINION on him or my relationship was NOT what I came here for! I think you were out of place, and immature to say the least. I would like to remind you that I told you ABSOLUTELY nothing about ME, so you can't tell me what I'm better off with or without. And lastly, you don't know ANY of the circumstances. I never told you about the events leading up to his decisions, and I KNOW I never said he was using, becuase that's not what he had the cocaine for. But like I said, I'm not here to agrue, I was simply giving the honest facts so I can get an honest answer on what WE can do to fix this. The last I checked, this is an immigration forum, not a relationship help forum.

Thanks Jerry for you're LEGIT information, and not some OPINION that has absolutely nothing to do with what I asked. :D

Well.. forgive me for answering your question, next time leave me a few hints and I will attempt to make my answer fit. You have two major problems, your boyfriend is a know drug user now, and he has a active arrest warrant out. There is no waiver for cocaine... He can't lie about it on the forms, because a records check will reveal the arrest. Have a nice day!
