hello

i need help on a problem i am having, i am currently trying to file my 1-485 1-130 and the medical exam altogether being about $2000 but we are having troubles saving up the funds to pay for everything, we only make enough to pay our bills and just barely that, i was wondering if there was any way for me to get work authorization or if there is any emergency or assistance programs for paying the fees.

yes i have already tried to borrow the money but no one has that kind of money on hand either my wife is only making a part time wage so a credit card or loan from the bank will not help either, being a veteran and just having a baby not too long ago she is not very healthy either she is limited on what work she can do since she has issues with her knee, she cannot get surgery done because she cannot afford to be off her feet and i would like to help but i cannot work yet

so our marriage is legit we have a 10 month old daughter i am not sure how i am to go about getting work or getting the money to pay for everything, i could go back to Canada but that would leave her with our daughter with no one to babysit and i really don't want to leave my child. i have been here almost a year now and am worried that even if i do leave that i may be subject to the 2 year ban for overstaying for more then 6 months. i just need advice for what i should do. i really don't want to leave my wife, step daughter and my daughter but if its what i need to do i am just worried about getting back in to the U.S

There is no fee waiver provision for an I-130, or for I-485 being filed as the spouse of a USC. The real problem you will have is the I-864, Affidavit of Support. Her verteran status may be valuable in seeking a subsidy from a charitable organization. Many communities do have a variety of non-profit organizations that offer assitance. Try googling for veteran or religious otganizations in your area.

The unlawful presence (ULP) bar kicks in at 6 months of ULP which is a 3 year bar. Once reaching one year ULP, the bar is 10 years. The ULP bar ONLY kicks in IF YOU DEPART THE U.S. BEFORE GETTING A GREENCARD.

i'm sorry i'm not sure what you mean by no fee waiver provision? are you saying that the fee must be paid?

i know that all the fees must be paid, i can have someone co sign my affidavit of support but finding a loan for $2000 in these times are hard

as of dec 29th i will be here unlawfully for 6 months since i know i am allowed to be here for up to 6 months lawfully

i know i can try getting help from church but most of the time they only help with things such as rent or utilities but i can try looking into that.

There are other community based organizations (CBO's) that specialize in helping people with their immigration cases and some offer financial help with filing fees, search for those. Some CBO's in your area might be listed on the list I linked for you. Also, U.S. Veteran groups sometimes help fellow vets. Keep looking.
