Hello, everyone. I need some advice on my Immigration case. I've been here before but its been a while. I was born in Mexico and brought to the U.S. in 1987 or 1988 at the age of five years old. My father is a U.S. resident, my mother (also an immigrant) applied for legal residence in 1999 through (Family Unity) and we were granted a work permit. We have to renew our permit every two years. When i as approximately 24 we applied for change of status form I485 (i believe form #) to obtain a green card, but mines was denied due to my age. According to an immigration lawyer i had to be under 21 or i would have to wait longer. It's been about 15 years now since we started the process and I'm wondering if there's anyone here that knows about situations like mine that can give me some advice. I check the immigration website but don't know how to read the processing times. Oh and by the way I have an appointment with a new Immigration lawyer this coming week to see if he can help.

UPDATE; My mom was approved i485 and is now a U.S resident.

It is possible to qualify as a derivative when you are over 21, if you're still within the extra time frame allowed by the CSPA (Child Status Protection Act). It is possible that you were wrongly denied when you were 24, and may have been able to successfully appeal.

How did your father get his green card? How did your mother get hers? Who applied for them? Who applied for you? What process was started 15 years ago -- your father applied for your mother? Those facts affect if and when you can get a green card.

Hey Jackolantern! Thanks for replying. Sorry i should have given some more insight. My father got his green card first during Reagan's presidency, i believe there was an immigration reform. My whole family applied for legal residency through my dad, since he is a legal U.S. Resident. The initial process was started in 1999 by a local immigration person (not sure if she was a lawyer) but after she filed the paper work (Family Unity), we were approved and issued work permits. In 2009, with a different Immigration Lawyer my mom applied for our green cards or status adjustment, form I485 (i believe) she was approved and was issued a green card withing a few months. But I was denied along with my two siblings (all over 21) because we were over 21 years old and were told we had to wait longer to obtain a green card. We even went to get our Medical exams. My mom was the one who started the process and paid the people/lawyer to fill all of our forms. Im not too sure for what did my parents apply but i know one is Family Unity Benefits and maybe asylum (not too sure about this one). Oh and I still get my Employment Authorization Permit every two years.

My Siblings got married to U.S. Citizens and became U.S. Residents with a few months. I'm the only one left and just looking to see if i can get some information about my current situation.

Thanks
