Respected.

I recently went to Delhi consulate for my h1 stamping on 21-Apr-2011. After the interview the representative gave my original I-797A form back with a green slip stating rejection reason in the "other" category "You have no qualifying employment.
Your petition will be returned to DHS"

  • Does this mean that my h1 approval is cancelled and I no longer have a valid status?
  • Can I go for stamping again
?
I have been working for my firm for the past 9 months and I was on f1 status before in US. Can you please suggest me the possible way to have a valid status again ?

Thanks for help.

----- it simply means that they are making a note that your employer is not being eligible to pay the wages Or does not have real job for you Or somebody in past reported to DOL that your employer has not paid. It is happening to many at this time. Consulate is going to send the report to USCIS and you should contact your Company and Company lawyer.

------------------ When you are out of US you are NOT on H1 status. Consulate is going to Inform the USCIS to revoke the H1 petition. Your Company lawyer should know how to deal with USCIS
  • Can I go for stamping again
------------- Talk to your company lawyer
